Following a pre-application enquiry for new developments to the property, the council considered the existing timber boundary fence to have a negative impact to the site, which had been erected without consent. Therefore, a planning application seeking to regularise the timber fence would likely be refused and followed by enforcement action. In response, SM Planning submitted a Certificate of Lawful Development supported by appropriate evidence to demonstrate that the existing timber fence had become lawful through the passage of time. A Certificate of Lawful Development was subsequently issued.
