DEVELOPMENT PROJECT SUMMARY
SM Planning were instructed to lead on a lawful development certificate (existing) to demonstrate that the 19 flats within the building were lawful. Subsequently, a lawful development certificate proposed was secured to amalgamate 4 of the dwellings into 2. SM Planning prepared a comprehensive submission that demonstrated, on the balance of probability, that the existing flats were lawful by virtue of the passage of time. We citied recent case law, appeal decisions and similar decisions in the borough to demonstrate that amalgamating the flats was not development for which planning permission was required.
